Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Ocular platform, API, and associated telemetry services. By deploying Ocular or accessing our API endpoints, you agree to be bound by these Terms. If you are integrating Ocular on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

TL;DR: Don't reverse-engineer our tracking engine. Respect the API rate limits. We provide analytics, but we cannot guarantee specific algorithmic rankings or AI behaviors.

1. Platform Access and API Usage

A. Enterprise Infrastructure Ocular provides programmatic access to generative search analytics. You are responsible for maintaining the security of your API keys and authentication tokens.

B. Rate Limits and Fair Use API access is subject to the rate limits defined in your subscription tier (Starter, Growth, or Enterprise). Attempting to bypass these limits, executing automated DDoS attacks, or utilizing undocumented endpoints will result in immediate API key revocation without refund.

C. Prohibited Conduct You agree not to:

  • Reverse-engineer, decompile, or attempt to extract the proprietary source code of Ocular’s NLP sentiment engine.

  • Resell or repackage raw Ocular API data as a competing analytics product without an explicit enterprise partnership agreement.

2. Subscription and Billing

Ocular operates on a subscription model. Billing occurs on a monthly or annual basis as selected during deployment.

  • Overage: If your API usage exceeds the limits of your current tier, you will be notified via email and automatically billed for overages at the standard endpoint rate, or required to upgrade your tier.

  • Cancellations: You may cancel your subscription at any time. Access will remain active until the end of your current billing cycle. We do not offer prorated refunds for partial months.

3. Limitation of Liability

A. Algorithmic Volatility Generative engines (LLMs) are highly volatile and constantly updated black-box systems. Ocular provides accurate, real-time telemetry based on the outputs of these models. However, Ocular does not guarantee that using our platform will result in increased brand visibility, positive sentiment, or specific rankings within any AI engine.

B. Service Interruptions While we strive for 99.99% uptime, Ocular shall not be held liable for temporary data gaps caused by sudden API changes from third-party engines (e.g., ChatGPT or Perplexity altering their DOM structure or API access).

4. Modifications to the Infrastructure

We continuously ship updates to our NLP models and API endpoints. We reserve the right to modify or deprecate specific features. For breaking API changes, we will provide all active users with a minimum of 60 days' notice via our Changelog and developer email lists.
